يَعْنِي مَا أَخْبَرَنَا أَبُو حَازِمٍ الْحَافِظُ أنا أَبُو الْحَسَنِ بْنُ حَمْزَةَ الْهَرَوِيُّ أنا أَحْمَدُ بْنُ نَجْدَةَ نا سَعِيدُ بْنُ مَنْصُورٍ نا هُشَيْمٌ أنا يُونُسُ بْنُ عُبَيْدٍ نا الْحَسَنُ أَنَّ رَجُلًا تَزَوَّجَ امْرَأَةً سِرًّا فَكَانَ يَخْتَلِفُ إِلَيْهَا فَرَآهُ جَارٌ لَهَا فَقَذَفَهُ بِهَا فَاسْتَعْدَى عَلَيْهِ عُمَرَ بْنَ الْخَطَّابِ ؓ فَقَالَ لَهُ عُمَرُ ؓ بَيِّنَتُكَ عَلَى تَزْوِيجِهَا فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ كَانَ أَمْرٌ دُونَ فَأَشْهَدْتُ عَلَيْهِ أَهْلَهَا فَدَرَأَ عُمَرُ ؓ الْحَدَّ عَنْ قَاذِفِهِ وَقَالَ حَصِّنُوا فَرُوجَ هَذِهِ النِّسَاءِ وَأَعْلِنُوا هَذَا النِّكَاحَ وَنَهَى عَنِ الْمُتْعَةِ
English Translation
Meaning what Abu Hazim al-Hafiz informed us... from al-Hasan, that a man married a woman secretly and would visit her frequently. A neighbor of hers saw him and accused him of immorality with her. He complained to Umar bin al-Khattab (may Allah be pleased with him). Umar said to him: Produce your evidence of marrying her. He said: O Commander of the Faithful, it was a private matter, so I had her family witness it. Umar (may Allah be pleased with him) waived the punishment from his accuser and said: Protect the honor of these women and announce this marriage publicly. And he forbade mut'ah (temporary marriage).
