أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ قَالَا ثنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ غَيْلَانَ ثنا أَبُو هِشَامٍ الرِّفَاعِيُّ ثنا أَبُو أُسَامَةَ عَنْ إِسْمَاعِيلَ عَنِ الشَّعْبِيِّ عَنْ شُرَيْحٍ قَالَ هُوَ الزَّوْجُ إِنْ شَاءَ أَتَمَّ لَهَا صَدَاقَهَا وَكَذَلِكَ قَالَ نَافِعُ بْنُ جُبَيْرٍ وَمُحَمَّدُ بْنُ كَعْبٍ وَطَاوُسٌ وَمُجَاهِدٌ وَالشَّعْبِيُّ وَسَعِيدُ بْنُ جُبَيْرٍ وَقَالَ إِبْرَاهِيمُ وَعَلْقَمَةُ وَالْحَسَنُ هُوَ الْوَلِيُّ وَرُوِيَ عَنِ ابْنِ لَهِيعَةَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ ﷺ وَلِيُّ عَقْدِ النِّكَاحِ الزَّوْجُ وَهَذَا غَيْرُ مَحْفُوظٍ وَابْنُ لَهِيعَةَ غَيْرُ مُحْتَجٍّ بِهِ وَاللهُ أَعْلَمُ
English Translation
Shurayh said: 'He is the husband - if he wishes, he completes her dowry for her.' Nafi' ibn Jubayr, Muhammad ibn Ka'b, Tawus, Mujahid, al-Sha'bi, and Sa'id ibn Jubayr said likewise. Ibrahim, Alqamah, and al-Hasan said: 'He is the guardian.' It was narrated from Ibn Lahi'ah from Amr ibn Shu'ayb from his father from his grandfather from the Prophet (peace be upon him): 'The guardian of the marriage tie is the husband.' But this is not authentic, and Ibn Lahi'ah is not relied upon as evidence. Allah knows best.
