وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ ثنا عَبْدُ الْوَهَّابِ بْنُ عَطَاءٍ عَنِ ابْنِ جُرَيْجٍ حَدَّثَنِي عَطَاءٌ الْخُرَاسَانِيُّ أَنَّ رَجُلًا نَكَحَ امْرَأَةً فَأَصْدَقَتْهُ الْمَرْأَةُ وَشَرَطَتْ عَلَيْهِ أَنَّ بِيَدِهَا أَمْرَ الْجِمَاعِ وَالْفُرْقَةِ فَقِيلَ لَهُ خَالَفْتَ السُّنَّةَ وَوَلَّيْتَ الْحَقَّ غَيْرَ أَهْلِهِ فَقَضَى ابْنُ عَبَّاسٍ أَنَّ عَلَيْهِ الصَّدَاقَ وَبِيَدِهِ الْجِمَاعُ وَالْفُرْقَةُ 14443 وَرَوَاهُ إِسْمَاعِيلُ بْنُ عَيَّاشٍ عَنْ عَطَاءٍ الْخُرَاسَانِيِّ أَنَّ عَلِيًّا وَابْنَ عَبَّاسٍ سُئِلَا عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً وَشَرَطَتْ عَلَيْهِ أَنَّ بِيَدِهَا الْفُرْقَةَ وَالْجِمَاعَ وَعَلَيْهَا الصَّدَاقُ فَقَالَا عَمِيتَ البيهقي ١٤٤٤٣: عن
English Translation
A man married a woman and she gave him the dowry and stipulated that the right of conjugal relations and separation be in her hands. It was said to him: You have contradicted the Sunnah and given the right to other than its rightful holder. Ibn Abbas ruled that the man must pay the dowry, and that conjugal relations and separation are in his hand. It was also reported that Ali and Ibn Abbas were asked about a man whose wife stipulated upon him that she holds the right of separation and conjugal relations and she pays the dowry. They both said: You are misguided.
