أَخْبَرَنَا أَبُو سَعْدٍ أَحْمَدُ بْنُ مُحَمَّدٍ الْمَالِينِيُّ أنا أَبُو أَحْمَدَ بْنُ عَدِيٍّ الْحَافِظُ ثنا أَبُو صَالِحٍ الْقَاسِمُ بْنُ اللَّيْثِ الرَّسْعَنِيُّ ثنا هِشَامُ بْنُ عَمَّارٍ ثنا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الْقَاضِي ثنا مُحَمَّدُ بْنُ السَّائِبِ عَنْ أَبِي صَالِحٍ عَنِ ابْنِ عَبَّاسٍ أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنْ مَوْلُودٍ وُلِدَ لَهُ قُبُلٌ وَذَكَرٌ مِنْ أَيْنَ يُوَرَّثُ؟ فَقَالَ النَّبِيُّ ﷺ يُوَرَّثُ مِنْ حَيْثُ يَبُولُ مُحَمَّدُ بْنُ السَّائِبِ الْكَلْبِيُّ لَا يُحْتَجُّ بِهِ
English Translation
Abu Sa'd Ahmad ibn Muhammad al-Malini informed us with his chain from Ibn Abbas that the Messenger of Allah (peace be upon him) was asked about a newborn born with both male and female genitalia - from which should inheritance be determined? The Prophet (peace be upon him) said: 'Inheritance is determined based on where the person urinates.' Muhammad ibn al-Sa'ib al-Kalbi is not relied upon.
