وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ ثنا يَحْيَى بْنُ أَبِي طَالِبٍ أنا يَزِيدُ أنا هَمَّامُ بْنُ يَحْيَى عَنْ قَتَادَةَ قَالَ سُجِنَ جَابِرُ بْنُ زَيْدٍ زَمَنَ الْحَجَّاجِ فَأَرْسَلُوا إِلَيْهِ يَسْأَلُونَهُ عَنِ الْخُنْثَى كَيْفَ يُوَرَّثُ فَقَالَ تَسْجِنُونَنِي وَتَسْتَفْتُونَنِي ثُمَّ قَالَ انْظُرُوا مِنْ حَيْثُ يَبُولُ فَوَرِّثْهُ مِنْهُ قَالَ قَتَادَةُ فَذَكَرْتُ ذَلِكَ لِسَعِيدِ بْنِ الْمُسَيِّبِ قَالَ فَإِنْ بَالَ مِنْهُمَا جَمِيعًا قُلْتُ لَا أَدْرِي فَقَالَ سَعِيدٌ يُوَرَّثُ مِنْ حَيْثُ يَسْبِقُ
English Translation
Abu Abdullah al-Hafiz informed us with his chain from Qatadah who said: Jabir ibn Zayd was imprisoned during the time of al-Hajjaj. They sent to him asking about the inheritance of a person of ambiguous sex. He said: 'You imprison me and then seek my religious opinion?' Then he said: 'Look at where they urinate and assign inheritance accordingly.' Qatadah said: I mentioned this to Sa'id ibn al-Musayyib. He said: 'What if the person urinates from both openings?' I said: 'I do not know.' Sa'id said: 'Inheritance is assigned based on which comes first.'
