وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْأَصْبَهَانِيُّ أنا أَبُو مُحَمَّدِ بْنُ حَيَّانَ حَدَّثَنِي الْعَبَّاسُ بْنُ الْوَلِيدِ ثنا مُحَمَّدُ بْنُ يَحْيَى ثنا مُوسَى بْنُ دَاوُدَ عَنْ عَبْدِ الْعَزِيزِ بْنِ أَبِي سَلَمَةَ عَنِ الزُّهْرِيِّ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ عَنْ أَبِي هُرَيْرَةَ قَالَ مِنَ السُّنَّةِ أَنْ لَا يَرِثَ الْمَنْفُوسُ وَلَا يُورَثُ حَتَّى يَسْتَهِلَّ صَارِخًا كَذَا وَجَدْتُهُ وَرَوَاهُ يَحْيَى بْنُ سَعِيدٍ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَرِثُ الصَّبِيُّ إِذَا لَمْ يَسْتَهِلَّ وَالِاسْتِهْلَالُ الصِّيَاحُ أَوِ الْعُطَاسُ أَوِ الْبُكَاءُ وَلَا يُكْمَلُ دِيَتُهُ وَقَالَ سَعِيدٌ لَا يُصَلَّى عَلَيْهِ وَرُوِيَ مِنْ حَدِيثِ جَابِرٍ مَوْقُوفًا وَمَرْفُوعًا وَقَدْ مَضَى فِي كِتَابِ الْجَنَائِزِ
English Translation
Abu Bakr ibn al-Harith al-Asbahani informed us with his chain from al-Zuhri from Sa'id ibn al-Musayyib from Abu Hurayrah who said: It is from the Sunnah that the newborn does not inherit nor is inherited from until it cries out at birth. Yahya ibn Sa'id narrated from Sa'id ibn al-Musayyib that the Messenger of Allah (peace be upon him) said: 'The child does not inherit if it does not cry out.' Crying out means screaming, sneezing, or crying. Its blood money is not completed. Sa'id said: Prayer is not offered over it. This was also narrated from Jabir, both as a stopped and raised report, as mentioned in the Book of Funerals.
