أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنا أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ ثنا عَلِيُّ بْنُ الْمَدِينِيِّ ثنا سُفْيَانُ عَنْ عَمْرٍو عَنْ عَوْسَجَةَ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ مَاتَ رَجُلٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَلَمْ يَتْرُكْ وَارِثًا إِلَّا عَبْدًا لَهُ هُوَ أَعْتَقَهُ فَأَعْطَاهُ رَسُولُ اللهِ ﷺ مِيرَاثَهُ وَخَالَفَهُمَا حَمَّادُ بْنُ زَيْدٍ فَرَوَاهُ عَنْ عَمْرِو بْنِ دِينَارٍ مُرْسَلًا
English Translation
Abu Sa'id informed us: Abu Abdullah narrated to us: Muhammad ibn Nasr narrated to us: Ishaq informed us: Abd al-Razzaq informed us: Ma'mar narrated from al-Zuhri: The first to apply the doctrine of awl (proportional reduction) in inheritance was Zayd ibn Thabit. Umar ibn al-Khattab (may Allah be pleased with him) consulted him, and he gave this ruling.
