وَأَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو أنا أَبُو عَبْدِ اللهِ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ نَصْرٍ ح وَأَخْبَرَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْفَارِسِيُّ أنا إِسْمَاعِيلُ بْنُ أَحْمَدَ الْخَلَّالِيُّ أنا أَبُو يَعْلَى قَالَا ثنا مُحَمَّدُ بْنُ بَكَّارٍ ثنا عَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللهِ بْنِ ذَكْوَانَ عَنْ أَبِيهِ عَنْ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ عَنْ أَبِيهِ أَنَّ مَعَانِيَ هَذِهِ الْفَرَائِضِ وَأُصُولَهَا كُلَّهَا عَنْ زَيْدِ بْنِ ثَابِتٍ وَأَمَّا التَّفْسِيرُ فَتَفْسِيرُ أَبِي الزِّنَادِ عَلَى مَعَانِي زَيْدٍ قَالَ يَرِثُ الرَّجُلُ مِنِ امْرَأَتِهِ إِذَا هِيَ لَمْ تَتْرُكْ وَلَدًا وَلَا وَلَدَ ابْنٍ النِّصْفَ فَإِنْ تَرَكَتْ وَلَدًا أَوْ وَلَدَ ابْنٍ ذَكَرًا أَوْ أُنْثَى وَرِثَهَا زَوْجُهَا الرُّبُعَ لَا يَنْقُصُ مِنْ ذَلِكَ شَيْءٌ وَتَرِثُ الْمَرْأَةُ مِنْ زَوْجِهَا إِذَا هُوَ لَمْ يَتْرُكْ وَلَدًا وَلَا وَلَدَ ابْنٍ الرُّبُعَ فَإِنْ تَرَكَ وَلَدًا أَوْ وَلَدَ ابْنٍ وَرِثَتْهُ امْرَأَتُهُ الثُّمُنَ
English Translation
Abu Sa'id ibn Abi Amr informed us: Abu Abdullah ibn Ya'qub narrated to us: Muhammad ibn Nasr narrated to us. And Abu Bakr Muhammad ibn Ibrahim al-Farisi informed us: Isma'il ibn Ahmad al-Khallali informed us: Abu Ya'la narrated to us. Both narrated from Muhammad ibn Bakkar: Abd al-Rahman ibn Abdullah ibn Dhakwan narrated from his father from Kharijah ibn Zayd ibn Thabit from his father: The meanings of these laws of inheritance and their principles are all from Zayd ibn Thabit, while the commentary is the interpretation of Abu al-Zinad based on the meanings of Zayd. He said: The husband inherits from his wife one-half if she left no child or grandchild. If she left a child or grandchild, male or female, her husband inherits one-quarter, and nothing less. The wife inherits from her husband one-quarter if he left no child or grandchild. If he left a child or grandchild, his wife inherits one-eighth.
