أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو أنا أَبُو عَبْدِ اللهِ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ نَصْرٍ ثنا مُحَمَّدُ بْنُ بَكَّارٍ ثنا عَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللهِ بْنِ ذَكْوَانَ عَنْ أَبِيهِ عَنْ خَارِجَةَ بْنِ زَيْدٍ عَنْ أَبِيهِ أَنَّ مَعَانِيَ هَذِهِ الْفَرَائِضِ وَأُصُولَهَا عَنْ زَيْدِ بْنِ ثَابِتٍ وَأَمَّا التَّفْسِيرُ فَتَفْسِيرُ أَبِي الزِّنَادِ عَلَى مَعَانِي زَيْدٍ قَالَ وَمِيرَاثُ الْإِخْوَةِ لِلْأُمِّ أَنَّهُمْ لَا يَرِثُونَ مَعَ الْوَلَدِ وَلَا مَعَ وَلَدِ الِابْنِ ذَكَرًا كَانَ أَوْ أُنْثَى شَيْئًا وَلَا مَعَ الْأَبِ وَلَا مَعَ الْجَدِّ أَبِي الْأَبِ شَيْئًا قَالَ وَمِيرَاثُ الْإِخْوَةِ لِلْأَبِ وَالْأُمِّ أَنَّهُمْ لَا يَرِثُونَ مَعَ الْوَلَدِ الذَّكَرِ وَلَا مَعَ وَلَدِ الِابْنِ الذَّكَرِ وَلَا مَعَ الْأَبِ شَيْئًا قَالَ وَمِيرَاثُ الْإِخْوَةِ لِلْأَبِ إِذَا لَمْ يَكُنْ مَعَهُمْ أَحَدٌ مِنْ بَنِي الْأُمِّ وَالْأَبِ كَمِيرَاثِ الْإِخْوَةِ لِلْأَبِ وَالْأُمِّ سَوَاءٌ فَإِذَا اجْتَمَعَ الْإِخْوَةُ مِنَ الْأَبِ وَالْأُمِّ وَالْإِخْوَةُ مِنَ الْأَبِ فَكَانَ فِي بَنِي الْأُمِّ وَالْأَبِ ذَكَرٌ فَلَا مِيرَاثَ مَعَهُ لِأَحَدٍ مِنَ الْإِخْوَةِ لِلْأَبِ
English Translation
Abu Sa'id ibn Abi Amr informed us: Abu Abdullah ibn Ya'qub narrated to us: Muhammad ibn Nasr narrated to us: Muhammad ibn Bakkar narrated to us: Abd al-Rahman ibn Abdullah ibn Dhakwan narrated from his father from Kharijah ibn Zayd from his father: The meanings of these laws of inheritance and their principles are from Zayd ibn Thabit, while the commentary is the interpretation of Abu al-Zinad based on the meanings of Zayd. He said: The inheritance of maternal brothers is that they do not inherit anything with a child, nor with a grandchild whether male or female, nor with the father, nor with the grandfather (father's father). And the inheritance of full siblings (from both parents) is that they do not inherit anything with a male child, nor with a male grandchild, nor with the father. And the inheritance of paternal siblings, when there are no full siblings with them, is the same as the inheritance of full siblings. When full siblings and paternal siblings gather and among the full siblings there is a male, then no paternal sibling inherits alongside him.
