حَدَّثَنَا الْحُسَيْنُ حَدَّثَنِي ابْنُ أَبِي الزِّنَادِ عَنْ عَبْدِ الرَّحْمَنِ يَعْنِي ابْنَ الْحَارِثِ أَخْبَرَنِي عَمْرُو بْنُ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّهُ سَمِعَ رَجُلًا مِنْ مُزَيْنَةَ سَأَلَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَاذَا تَقُولُ يَا رَسُولَ اللَّهِ فِي ضَالَّةِ الْإِبِلِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَا لَكَ وَلَهَا مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا قَالَ فَضَالَّةُ الْغَنَمِ قَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ قَالَ فَمَنْ أَخَذَهَا مِنْ مَرْتَعِهَا قَالَ عُوقِبَ وَغُرِّمَ مِثْلَ ثَمَنِهَا وَمَنْ اسْتَطْلَقَهَا مِنْ عِقَالٍ أَوْ اسْتَخْرَجَهَا مِنْ حِفْشٍ وَهِيَ الْمَظَالُّ فَعَلَيْهِ الْقَطْعُ قَالَ يَا رَسُولَ اللَّهِ فَالثَّمَرُ يُصَابُ فِي أَكْمَامِهِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَيْسَ عَلَى آكِلٍ سَبِيلٌ فَمَنْ اتَّخَذَ خُبْنَةً غُرِّمَ مِثْلَ ثَمَنِهَا وَعُوقِبَ وَمَنْ أَخَذَ شَيْئًا مِنْهَا بَعْدَ أَنْ أَوَى إِلَى مِرْبَدٍ أَوْ كَسَرَ عَنْهَا بَابًا فَبَلَغَ مَا يَأْخُذُ ثَمَنَ الْمِجَنِّ فَعَلَيْهِ الْقَطْعُ قَالَ يَا رَسُولَ اللَّهِ فَالْكَنْزُ نَجِدُهُ فِي الْخَرِبِ وَفِي الْآرَامِ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ.
English Translation
Al-Husayn narrated to us: Ibn Abi al-Zinad narrated to me from Abd al-Rahman - meaning Ibn al-Harith - Amr ibn Shu'ayb informed me from his father from his grandfather that he heard a man from Muzaynah ask the Messenger of Allah (peace be upon him): "What do you say, O Messenger of Allah, about stray camels?" The Messenger of Allah (peace be upon him) said: "What concern are they to you? They have their hooves and their water supply." He said: "What about stray sheep?" He said: "They are for you, or for your brother, or for the wolf." He said: "What about one who takes them from their pasture?" He said: "He is punished and fined the equivalent of their value." He said: "And one who unties them from their tether or takes them out from a shelter - meaning shaded enclosures - he must face amputation." He said: "O Messenger of Allah, what about fruit picked while still on the trees?" The Messenger of Allah (peace be upon him) said: "There is no liability on one who eats. Whoever takes a handful is fined the equivalent of its value and punished. Whoever takes something from it after it has been gathered into a storage area or breaks a door to reach it, and what he takes reaches the value of a shield, then amputation is applied." He said: "O Messenger of Allah, what about treasure we find in ruins and in stone piles?" The Messenger of Allah (peace be upon him) said: "In it and in buried treasure (rikaz), the fifth is due."
