حَدَّثَنَا عَفَّانُ حَدَّثَنَا هَمَّامٌ قَالَ أَخْبَرَنَا قَتَادَةُ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ أَنَّ زَوْجَ بَرِيرَةَ كَانَ عَبْدًا أَسْوَدَ يُسَمَّى مُغِيثًا قَالَ فَكُنْتُ أَرَاهُ يَتْبَعُهَا فِي سِكَكِ الْمَدِينَةِ يَعْصِرُ عَيْنَيْهِ عَلَيْهَا قَالَ وَقَضَى فِيهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَرْبَعَ قَضِيَّاتٍ إِنَّ مَوَالِيَهَا اشْتَرَطُوا الْوَلَاءَ فَقَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْوَلَاءَ لِمَنْ أَعْتَقَ وَخَيَّرَهَا فَاخْتَارَتْ نَفْسَهَا فَأَمَرَهَا أَنْ تَعْتَدَّ قَالَ وَتُصُدِّقَ عَلَيْهَا بِصَدَقَةٍ فَأَهْدَتْ مِنْهَا إِلَى عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا فَذَكَرَتْ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ هُوَ عَلَيْهَا صَدَقَةٌ وَإِلَيْنَا هَدِيَّةٌ.
English Translation
The husband of Barirah was a black slave named Mughith. I used to see him following her through the streets of Madinah, weeping over her. The Prophet (peace be upon him) issued four rulings regarding her: Her previous owners stipulated (that they retain) the right of loyalty (wala'), but the Prophet (peace be upon him) ruled that the wala' belongs to the one who emancipates. He gave her the choice, and she chose herself. He ordered her to observe the waiting period. And she was given charity, and she presented some of it as a gift to Aishah. Aishah mentioned that to the Prophet (peace be upon him), and he said: 'For her it is charity, and for us it is a gift.'
