حَدَّثَنَا عُثْمَانُ بْنُ عُمَرَ قَالَ حَدَّثَنَا أُسَامَةُ بْنُ زَيْدٍ قَالَ حَدَّثَنَا الْقَاسِمُ بْنُ مُحَمَّدٍ قَالَ سَمِعْتُ عَائِشَةَ أُمَّ الْمُؤْمِنِينَ تَقُولُ إِنَّ بَرِيرَةَ كَانَتْ مُكَاتِبَةً لِأُنَاسٍ مِنْ الْأَنْصَارِ فَأَرَدْتُ أَنْ أَبْتَاعَهَا فَأَمَرْتُهَا أَنْ تَأْتِيَهُمْ فَتُخْبِرَهُمْ أَنِّي أُرِيدُ أَنْ أَبْتَاعَهَا فَأُعْتِقَهَا فَقَالُوا إِنْ جَعَلْتِ لَنَا وَلَاءَهَا ابْتَعْنَاهَا مِنْهَا فَاسْتَفْتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ اشْتَرِيهَا فَأَعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ وَدَخَلَ عَلَيَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَالْمِرْجَلُ يَفُورُ بِلَحْمٍ فَقَالَ مِنْ أَيْنَ لَكِ هَذَا قُلْتُ أَهْدَتْهُ لَنَا بَرِيرَةُ وَتُصُدِّقَ بِهِ عَلَيْهَا فَقَالَ هَذَا لبَرِيرَةَ صَدَقَةٌ وَلَنَا هَدِيَّةٌ قَالَتْ وَكَانَتْ تَحْتَ عَبْدٍ فَلَمَّا أَعْتَقَهَا قَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اخْتَارِي فَإِنْ شِئْتِ أَنْ تَمْكُثِي تَحْتَ هَذَا الْعَبْدِ وَإِنْ شِئْتِ أَنْ تُفَارِقِيهِ.
English Translation
Uthman ibn Umar told us, he said: Usamah ibn Zayd told us, he said: al-Qasim ibn Muhammad told us, he said: I heard Aisha, Mother of the Believers, saying: "Barirah was a mukatabah (a slave under a contract to purchase her freedom by installments) belonging to some people of the Ansar. I wanted to buy her, so I ordered her to go to them and tell them that I wished to buy her and free her. They said, 'If you make her wala' belong to us, we will sell her to you.' So I sought a ruling from the Messenger of Allah, peace and blessings be upon him, and he said, 'Buy her and free her, for the wala' belongs only to the one who frees.' And the Messenger of Allah, peace and blessings be upon him, entered upon me while the cooking pot was boiling with meat, and he said, 'Where did you get this from?' I said, 'Barirah was given it as a gift, and it had been given to her as charity.' He said, 'This is charity for Barirah, but a gift for us.'" She said: And she had been married to a slave; when she freed her, the Messenger of Allah, peace and blessings be upon him, said to her, "Choose: if you wish, remain with this slave, and if you wish, separate from him."
