حَدَّثَنَا وَكِيعٌ حَدَّثَنَا سُفْيَانُ عَنْ عَمْرِو بْنِ دِينَارٍ قَالَ سَمِعْتُ ابْنَ عُمَرَ يَقُولُ كُنَّا نُخَابِرُ وَلَا نَرَى بِذَلِكَ بَأْسًا حَتَّى زَعَمَ رَافِعُ بْنُ خَدِيجٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْهُ قَالَ عَمْرٌو ذَكَرْتُهُ لِطَاوُسٍ فَقَالَ طَاوُسٌ قَالَ ابْنُ عَبَّاسٍ إِنَّمَا قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَمْنَحُ أَحَدُكُمْ أَخَاهُ الْأَرْضَ خَيْرٌ لَهُ مِنْ أَنْ يَأْخُذَ لَهَا خَرَاجًا مَعْلُومًا.
English Translation
Ibn Abbas said: Ibn Umar said: 'We used to practice sharecropping and did not see anything wrong with it until Rafi' ibn Khadij claimed that the Messenger of Allah (peace be upon him) forbade it.' Amr said: I mentioned this to Tawus, and Tawus said: Ibn Abbas said: 'The Messenger of Allah (peace be upon him) only said: It is better for one of you to give his land to his brother than to charge him a fixed rent for it.'
