حَدَّثَنِي مُحَمَّدُ بْنُ عَبَّادٍ الْمَكِّيُّ حَدَّثَنَا حَاتِمُ بْنُ إِسْمَاعِيلَ عَنْ عَبْدِ الْمَلِكِ بْنِ حَسَنٍ الْجَارِيِّ عَنْ عُمَارَةَ بْنِ حَارِثَةَ عَنْ عَمْرِو بْنِ يَثْرِبِيٍّ قَالَ خَطَبَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ أَلَا وَلَا يَحِلُّ لِامْرِئٍ مِنْ مَالِ أَخِيهِ شَيْءٌ إِلَّا بِطِيبِ نَفْسٍ مِنْهُ فَقُلْتُ يَا رَسُولَ اللَّهِ أَرَأَيْتَ إِنْ لَقِيتُ غَنَمَ ابْنِ عَمِّي أَجْتَزِرُ مِنْهَا شَاةً فَقَالَ إِنْ لَقِيتَهَا نَعْجَةً تَحْمِلُ شَفْرَةً وَأَزْنَادًا بِخَبْتِ الْجَمِيشِ فَلَا تَهِجْهَا قَالَ يَعْنِي خَبْتَ الْجَمِيشِ أَرْضًا بَيْنَ مَكَّةَ وَالْجَارِ لَيْسَ بِهَا أَنِيسٌ.
English Translation
Muhammad ibn 'Abbad al-Makki told me, Hatim ibn Isma'il told us, from 'Abd al-Malik ibn Hasan al-Jari, from 'Umarah ibn Haritha, from 'Amr ibn Yathribi, who said: The Messenger of Allah, peace and blessings be upon him, delivered a sermon to us and said: "Indeed, it is not lawful for a man to take anything from his brother's property except with his willing consent." So I said: "O Messenger of Allah, what do you think if I come upon the sheep of my paternal cousin -- may I slaughter a sheep from it?" He said: "If you come upon it as a ewe carrying a knife and flints in the barren, waterless wasteland, do not disturb it." He said: meaning the barren, waterless wasteland is a land between Mecca and al-Jar, uninhabited.
