حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ وَعَبْدُ اللَّهِ بْنُ بَكْرٍ قَالَا حَدَّثَنَا سَعِيدٌ عَنْ قَتَادَةَ عَنْ حَبِيبِ بْنِ سَالِمٍ قَالَ ابْنُ بَكْرٍ مَوْلَى النُّعْمَانِ بْنِ بَشِيرٍ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ أَنَّهُ رُفِعَ إِلَيْهِ رَجُلٌ غَشِيَ جَارِيَةَ امْرَأَتِهِ فَقَالَ لَأَقْضِيَنَّ فِيهَا بِقَضِيَّةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِنْ كَانَتْ أَحَلَّتْهَا لَكَ جَلَدْتُكَ مِائَةَ جَلْدَةٍ وَإِنْ كَانَتْ لَمْ تُحِلَّهَا لَكَ رَجَمْتُكَ قَالَ فَوَجَدَهَا قَدْ كَانَتْ أَحَلَّتْهَا لَهُ فَجَلَدَهُ مِائَةً.
English Translation
Muhammad b. Ja'far and Abdullah b. Bakr told us, they said: Sa'id told us, from Qatada, from Habib b. Salim - Ibn Bakr said: the freedman of al-Nu'man b. Bashir - from al-Nu'man b. Bashir, that a man was brought before him who had had relations with his wife's slave girl. He said, "I shall judge in this matter with the judgment of the Messenger of Allah, peace and blessings be upon him: if she permitted her to you, I shall flog you a hundred lashes; and if she did not permit her to you, I shall stone you." He found that she had indeed permitted her to him, so he flogged him a hundred lashes.
