حَدَّثَنَا مَحْمُودُ بْنُ خَالِدٍ، حَدَّثَنَا الْفِرْيَابِيُّ، حَدَّثَنَا الْحَارِثُ بْنُ سُلَيْمَانَ، حَدَّثَنِي كُرْدُوسٌ، عَنِ الأَشْعَثِ بْنِ قَيْسٍ، أَنَّ رَجُلاً، مِنْ كِنْدَةَ وَرَجُلاً مِنْ حَضْرَمَوْتَ اخْتَصَمَا إِلَى النَّبِيِّ صلى الله عليه وسلم فِي أَرْضٍ مِنَ الْيَمَنِ فَقَالَ الْحَضْرَمِيُّ يَا رَسُولَ اللَّهِ إِنَّ أَرْضِي اغْتَصَبَنِيهَا أَبُو هَذَا وَهِيَ فِي يَدِهِ . قَالَ " هَلْ لَكَ بَيِّنَةٌ " . قَالَ لاَ وَلَكِنْ أُحَلِّفُهُ وَاللَّهِ مَا يَعْلَمُ أَنَّهَا أَرْضِي اغْتَصَبَنِيهَا أَبُوهُ فَتَهَيَّأَ الْكِنْدِيُّ لِلْيَمِينِ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " لاَ يَقْتَطِعُ أَحَدٌ مَالاً بِيَمِينٍ إِلاَّ لَقِيَ اللَّهَ وَهُوَ أَجْذَمُ " . فَقَالَ الْكِنْدِيُّ هِيَ أَرْضُهُ .
English Translation
Hadrat Al-Ash'ath ibn Qays (may Allah be well pleased with him) narrates that a man from the tribe of Kindah and a man from Hadramawt brought a dispute before the Beloved Prophet (blessings and peace of Allah be upon him) regarding a piece of land in Yemen. The man from Hadramawt submitted: O Beloved Messenger of Allah (blessings and peace of Allah be upon him), this man's father usurped my land and it is now in his possession. The Beloved Prophet (blessings and peace of Allah be upon him) asked: Do you have evidence? He submitted: No, but I ask that he be made to swear an oath, and Allah knows well that it is my land which his father usurped. The man from Kindah prepared to take the oath. The Beloved Messenger of Allah (blessings and peace of Allah be upon him) then stated: 'Whoever seizes another's property by swearing an oath will meet Allah on the Day of Resurrection as a leper.' Upon hearing this, the man from Kindah submitted: It is his land.
Urdu Translation
حضرت اشعث بن قیس رضی اللہ تعالیٰ عنہ سے روایت ہے کہ قبیلہ کندہ کا ایک شخص اور حضرموت کا ایک شخص یمن کی ایک زمین کے بارے میں نبی کریم صلی اللہ تعالیٰ علیہ وآلہ وسلم کے پاس جھگڑا لے کر آئے۔ حضرمی نے عرض کیا: یا رسول اللہ! میری زمین اس کے باپ نے مجھ سے غصب کی تھی اور اب وہ اس کے قبضے میں ہے۔ آپ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے ارشاد فرمایا: تمہارے پاس گواہی ہے؟ اس نے عرض کیا: نہیں، لیکن میں اسے قسم دلاتا ہوں، اور اللہ کو معلوم ہے کہ یہ میری زمین ہے جو اس کے باپ نے غصب کی۔ تو کندی قسم کھانے کو تیار ہوا۔ رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے ارشاد فرمایا: جو شخص قسم کھا کر کسی کا مال ہڑپ کرے تو قیامت کے دن اللہ تعالیٰ سے کوڑھی ہو کر ملے گا۔ (یہ سن کر) کندی نے عرض کیا: یہ اسی کی زمین ہے۔
