حَدَّثَنَا سُلَيْمَانُ بْنُ دَاوُدَ الْمَهْرِيُّ، حَدَّثَنَا ابْنُ وَهْبٍ، أَخْبَرَنِي اللَّيْثُ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ صَدَقَةِ، عُمَرَ بْنِ الْخَطَّابِ رضى الله عنه قَالَ نَسَخَهَا لِي عَبْدُ الْحَمِيدِ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُمَرَ بْنِ الْخَطَّابِ بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ هَذَا مَا كَتَبَ عَبْدُ اللَّهِ عُمَرُ فِي ثَمْغٍ فَقَصَّ مِنْ خَبَرِهِ نَحْوَ حَدِيثِ نَافِعٍ قَالَ غَيْرَ مُتَأَثِّلٍ مَالاً فَمَا عَفَا عَنْهُ مِنْ ثَمَرِهِ فَهُوَ لِلسَّائِلِ وَالْمَحْرُومِ - قَالَ وَسَاقَ الْقِصَّةَ - قَالَ وَإِنْ شَاءَ وَلِيُّ ثَمْغٍ اشْتَرَى مِنْ ثَمَرِهِ رَقِيقًا لِعَمَلِهِ وَكَتَبَ مُعَيْقِيبٌ وَشَهِدَ عَبْدُ اللَّهِ بْنُ الأَرْقَمِ بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ هَذَا مَا أَوْصَى بِهِ عَبْدُ اللَّهِ عُمَرُ أَمِيرُ الْمُؤْمِنِينَ إِنْ حَدَثَ بِهِ حَدَثٌ أَنَّ ثَمْغًا وَصِرْمَةَ بْنَ الأَكْوَعِ وَالْعَبْدَ الَّذِي فِيهِ وَالْمِائَةَ سَهْمٍ الَّتِي بِخَيْبَرَ وَرَقِيقَهُ الَّذِي فِيهِ وَالْمِائَةَ الَّتِي أَطْعَمَهُ مُحَمَّدٌ صلى الله عليه وسلم بِالْوَادِي تَلِيهِ حَفْصَةُ مَا عَاشَتْ ثُمَّ يَلِيهِ ذُو الرَّأْىِ مِنْ أَهْلِهَا أَنْ لاَ يُبَاعَ وَلاَ يُشْتَرَى يُنْفِقُهُ حَيْثُ رَأَى مِنَ السَّائِلِ وَالْمَحْرُومِ وَذِي الْقُرْبَى وَلاَ حَرَجَ عَلَى مَنْ وَلِيَهُ إِنْ أَكَلَ أَوْ آكَلَ أَوِ اشْتَرَى رَقِيقًا مِنْهُ .
English Translation
It is narrated through Yahya ibn Sa'id regarding the charitable endowment of Hadrat Umar ibn al-Khattab (may Allah be well pleased with him). He says that Abd al-Hamid ibn Abdullah ibn Abdullah ibn Umar ibn al-Khattab copied for him the following: In the name of Allah, the Most Compassionate, the Most Merciful. This is what Allah's servant Umar wrote regarding Thamgh (the name of the endowed estate). He then narrated the details similar to the tradition of Nafi', stating: 'provided he is not hoarding wealth.' Whatever surplus fruit remains shall be for those who ask and those who are deprived. The narrator said he then related the full account. It further states: If the custodian of Thamgh wishes, he may purchase slaves for its work from its fruits. Mu'ayqib wrote it and Abdullah ibn al-Arqam witnessed it. In the name of Allah, the Most Compassionate, the Most Merciful. This is the bequest of Allah's servant Umar, Commander of the Faithful: If something befalls me (i.e., I die), then Thamgh, Sirmah ibn al-Akwa', the slave therein, the hundred shares at Khaybar, the slaves therein, and the hundred shares which Muhammad (blessings and peace of Allah be upon him) granted me in the valley -- all shall be under the custodianship of Hadrat Hafsah (may Allah be well pleased with her) during her lifetime, then the most judicious person from her family shall be custodian. It shall neither be sold nor purchased. It shall be spent where seen fit upon those who ask, the deprived, and relatives. There is no blame on the custodian if he eats from it, feeds others, or purchases slaves from its revenue.
Urdu Translation
حضرت یحییٰ بن سعید سے حضرت عمر بن خطاب رضی اللہ تعالیٰ عنہ کے صدقہ کے بارے میں روایت ہے، وہ فرماتے ہیں کہ عبدالحمید بن عبداللہ بن حضرت عبداللہ بن عمر بن خطاب نے مجھے نقل کر کے دیا: بسم اللہ الرحمٰن الرحیم، یہ وہ دستاویز ہے جو اللہ کے بندے عمر نے ثمغ (یہ وقف شدہ باغ یا مال کا نام ہے) کے بارے میں لکھا۔ پھر نافع کی حدیث کی مانند تفصیل بیان کی، اس میں ہے: مال جوڑنے والا نہ ہو، جو پھل بچ جائے وہ سائل اور محروم کے لیے ہے۔ راوی کہتے ہیں: پھر پورا واقعہ بیان کیا۔ اس میں ہے: اگر ثمغ کا متولی چاہے تو اس کے پھلوں سے کام کے لیے غلام خرید سکتا ہے۔ معیقیب نے اسے لکھا اور عبداللہ بن ارقم نے گواہی دی۔ بسم اللہ الرحمٰن الرحیم، یہ اللہ کے بندے امیر المؤمنین عمر کی وصیت ہے: اگر مجھے کوئی حادثہ پیش آ جائے تو ثمغ، صرمۃ بن اکوع، اس میں موجود غلام، خیبر کے سو حصے، وہاں کے غلام، اور وادی میں وہ سو حصے جو محمد صلی اللہ تعالیٰ علیہ وآلہ وسلم نے مجھے عطا فرمائے تھے -- ان سب کی متولیہ حفصہ (رضی اللہ تعالیٰ عنہا) رہیں گی جب تک وہ زندہ رہیں، پھر ان کے اہل میں سے صاحبِ رائے شخص متولی ہو گا۔ نہ بیچا جائے نہ خریدا جائے۔ سائل، محروم اور قرابت داروں پر جہاں مناسب سمجھے خرچ کیا جائے گا۔ متولی اگر خود کھائے یا کھلائے یا اس سے غلام خریدے تو کوئی حرج نہیں۔
