Ḥadīth | Ṭabarānī (الطبراني) tabarani:3482 حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الدَّبَرِيُّ عَنْ عَبْدِ الرَّزَّاقِ عَنِ ابْنِ عُيَيْنَةَ أَخْبَرَنِي عَمْرُو بْنُ دِينَارٍ عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ قَامَ عُمَرُ ؓ عَلَى الْمِنْبَرِ فَقَالَ أُذَكِّرُ اللهَ امْرَأً سَمِعَ رَسُولَ اللهِ ﷺ قَضَى فِي الْجَنِينِ فَقَامَ حَمَلُ بْنُ مَالِكِ بْنِ النَّابِغَةِ الْهُذَلِيُّ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ كُنْتُ بَيْنَ جَارِتَيْنِ يَعْنِي ضَرَّتَيْنِ فَجَرَحَتْ أَوْ ضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِعَمُودِ ظُّلَّتِها فَقَتَلَتْهَا وَقَتَلَتْ مَا فِي بَطْنِهَا «فَقَضَى النَّبِيُّ ﷺ فِي الْجَنِينِ بِغُرَّةِ عَبْدٍ أَوْ أَمَةٍ» فَقَالَ عُمَرُ اللهُ أَكْبَرُ لَوْ لَمْ نَسْمَعْ بِهَذَا مَا قَضَيْنَا بِغَيْرِهِ

Narrated Ibn Abbas: Umar (may Allah be pleased with him) stood on the pulpit and said, 'I remind by Allah any man who heard the Messenger of Allah (peace be upon him) give a ruling regarding the fetus.' Hamal ibn Malik ibn al-Nabighah al-Hudhali stood and said, 'O Commander of the Faithful, I was between two co-wives, and one of them struck the other with a tent pole, killing her and killing what was in her womb.' The Prophet (peace be upon him) ruled that the blood money for the fetus was a ghurrah (a male or female slave). Umar said, 'Allahu Akbar! Had we not heard this, we would not have judged otherwise.'
