Muhammad ibn al-Hasan ibn Qutaybah al-Lakhmi informed us at Asqalan, Ibn Abi al-Sarri narrated to us, 'Abd al-Razzaq narrated to us, Ma'mar informed us from al-Zuhri, Malik ibn Aws ibn al-Hadathan informed me, he said: Hadrat 'Umar ibn al-Khattab sent for me and said: Indeed, some families from your people have come to Madinah, and we have ordered some provision for them, so distribute it among them. I said: O Commander of the Faithful, appoint someone other than me for this. He said: Take it, O man. He said: While I was thus, his client Yarfa came and said: This is Hadrat 'Uthman, 'Abd al-Rahman ibn 'Awf, Sa'd ibn Abi Waqqas, and al-Zubayr ibn al-'Awwam - he said: And I do not know if he mentioned Talhah or not - seeking permission to enter upon you. He said: Grant them permission. He said: Then he remained for a while, then he came and said: Al-'Abbas and 'Ali are seeking permission to enter upon you. He said: Grant them permission. When al-'Abbas entered, he said: O Commander of the Faithful, judge between me and this one - they were disputing at that time regarding what Allah had granted as fay' to His Messenger from the wealth of Banu al-Nadir. The people said: Judge between them, O Commander of the Faithful, and relieve each of them from the other, for their dispute has been prolonged. 'Umar said: I adjure you by Allah, by whose permission the heavens and earth stand, do you know that the Messenger of Allah ﷺ said: «We are not inherited. What we leave is charity»? They said: He said that. Then he said to both of them similarly. They said: Yes. He said: Indeed, I will inform you about this fay'. Allah, Exalted is He, specified His Prophet ﷺ with something He did not give to anyone else, for He said: {What Allah granted as fay' to His Messenger from them, you did not spur horses or camels for it.} So this was specifically for the Messenger of Allah ﷺ. And by Allah, he did not hoard it to your exclusion, nor did he withhold it from you. He distributed it among you and dispersed it among you until this wealth remained. He would spend on his family for a year - and perhaps Ma'mar said: He would withhold from it the sustenance of his family for a year - then he would place what remained as he would place the wealth of Allah. When Allah took His Messenger ﷺ, Abu Bakr said: I am most entitled to the Messenger of Allah ﷺ after him. I will act regarding it as he used to act. Then he turned to 'Ali and al-'Abbas and said: And you both claim that he was unjust and sinful regarding it. And Allah knows that he was truthful, righteous, and following the truth. Then I was given charge of it after Abu Bakr for two years of my leadership, and I acted regarding it similarly to what the Messenger of Allah ﷺ and Abu Bakr acted. And you both claim that I am unjust and sinful regarding it. And Allah knows that I am truthful, righteous, and following the truth regarding it. Then you both came to me - this one, meaning al-'Abbas, came to me seeking his inheritance from his nephew, and this one, meaning 'Ali, came to me asking for the inheritance of his wife. So I said to you both: Indeed, I heard the Messenger of Allah ﷺ say: «We are not inherited. What we leave is charity.» Then it occurred to me to give it to you both, so I took from you both the covenant and promise of Allah that you would act regarding it as the Messenger of Allah ﷺ, Abu Bakr, and I acted regarding it when I was given charge of it. So you both said: Give it to us on that condition. Do you want from me a judgment other than this? By Him by whose permission the heavens and earth stand, I will not judge between you regarding it with a judgment other than this. If you are unable to handle it, then return it to me. He said: So 'Ali prevailed regarding it, and it was in the hand of 'Ali, then in the hand of Hasan ibn 'Ali, then in the hand of Husayn ibn 'Ali, then in the hand of 'Ali ibn Husayn, then in the hand of Hasan ibn Hasan, then in the hand of Zayd ibn Hasan.
