It is narrated from Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace be upon him) gave judgment in the case of two women of the tribe of Hudhayl who had quarreled with each other. One struck the other, who was pregnant, on the belly with a stone, and the child died inside. This case was presented before him (peace be upon him), and he (peace be upon him) ordered a slave-girl or a male slave to be given as the blood-money (diyah) for the child. On hearing this, the guardian of the killer woman said: How can there be blood-money for a child who was in the womb, who neither ate nor drank nor spoke nor cried out? Surely it is a case that should be pardoned. The Prophet (peace be upon him) said: "This one seems to be a brother of the soothsayers."
الترجمة الأردية
سیدنا ابوہریرہ رضی اللہ عنہ سے روایت ہے کہرسول اللہصلی اللہ علیہ وسلمنے قبیلہ ہذیل کی دو عورتوں کے مقدمے کا فیصلہ فرمایا جو آپس میں لڑی تھیں۔ ایک نے دوسری حاملہ کے پیٹ پر پتھر مارا، بچہ اندر مر گیا۔ یہ مقدمہ آپصلی اللہ علیہ وسلمکے سامنے پیش کیا گیا تو آپصلی اللہ علیہ وسلمنے بچہ کی دیت میں باندی یا غلام دینے کا حکم فرمایا۔ یہ سن کر قاتلہ عورت کے وارث نے کہا کہ جو بچہ پیٹ میں تھا اس نے نہ کھایا نہ پیا نہ بولا نہ چیخا تو اس کی دیت کیسے ہے؟ وہ تو قابل معافی ہے۔ نبی کریمصلی اللہ علیہ وسلمنے فرمایا:”یہ کوئی کاہنوں کا بھائی معلوم ہوتا ہے۔“[مختصر صحيح بخاري/حدیث: 1979]
