أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ حَدَّثَنِي شَيْخٌ مِنْ أَهْلِ مَكَّةَ قَالَ سَمِعْتُ طَاوُسًا وَأَنَا وَاقِفٌ عَلَى رَأْسِهِ يَسْأَلُ عَنْ بَيْعِ الصَّدَقَةِ قَبْلَ أَنْ تُقْبَضَ فَقَالَ طَاوُسٌ وَرَبِّ هَذَا الْبَيْتِ لَا يَحِلُّ بَيْعُهَا قَبْلَ أَنْ تُقْبَضَ وَلَا بَعْدَ أَنْ تُقْبَضَ قَالَ الشَّافِعِيُّ لِأَنَّ رَسُولَ اللهِ ﷺ أَمَرَ أَنْ تُؤْخَذَ مِنْ أَغْنِيَائِهِمْ فَتُرَدَّ عَلَى فُقَرَائِهِمْ فُقَرَاءِ أَهْلِ السُّهْمَانِ فَتُرَدُّ بِعَيْنِهَا وَلَا يُرَدُّ ثَمَنُهَا قَالَ الشَّيْخُ وَالْأَخْبَارُ الَّتِي وَرَدَتْ فِي فَرَائِضِ الصَّدَقَاتِ وَتَقْدِيرِ الْجُبْرَانَاتِ دَلِيلٌ فِي هَذِهِ الْمَسْأَلَةِ
الترجمة الإنجليزية
Abu Sa'id ibn Abi Amr informed us... al-Shafi'i narrated... he heard Tawus being asked about selling charity before it is collected. Tawus said: 'By the Lord of this House, it is not permissible to sell it before it is collected, nor after it is collected.' Al-Shafi'i said: Because the Messenger of Allah (peace be upon him) ordered that it be taken from the wealthy and returned to the poor - the poor among the categories of recipients - to be returned in its original form and not its price. The Shaykh said: The reports concerning the prescribed charities and the compensatory payments are evidence in this matter.
