وَوَجَدْنَا عُمَرَ ؓ أَجْلَى الْيَهُودَ مِنْ جَزِيرَةِ الْعَرَبِ وَضَرَبَ لَهُمْ أَجَلًا ثَلَاثًا فَرَأَيْنَا ثَلَاثًا مِمَّا يُقِيمُ الْمُسَافِرُ وَأَرْبَعًا كَأَنَّهَا بِالْمُقِيمِ أَشْبَهُ لِأَنَّهُ لَوْ كَانَ لِلْمُسَافِرِ أَنْ يُقِيمَ أَكْثَرَ مِنْ ثَلَاثٍ كَانَ شَبِيهًا أَنْ يَأْمُرَ النَّبِيُّ ﷺ بِهِ الْمُهَاجِرَ وَيَأْذَنَ فِيهِ عُم��رُ ؓ لِلْيَهُودِ قَالَ الشَّيْخُ فَأَمَّا الْحَدِيثُ الَّذِي وَوَجَدْنَا عُمَرَ ؓ أَجْلَى الْيَهُودَ مِنْ جَزِيرَةِ الْعَرَبِ وَضَرَبَ لَهُمْ أَجَلًا ثَلَاثًا فَرَأَيْنَا ثَلَاثًا مِمَّا يُقِيمُ الْمُسَافِرُ وَأَرْبَعًا كَأَنَّهَا بِالْمُقِيمِ أَشْبَهُ لِأَنَّهُ لَوْ كَانَ لِلْمُسَافِرِ أَنْ يُقِيمَ أَكْثَرَ مِنْ ثَلَاثٍ كَانَ شَبِيهًا أَنْ يَأْمُرَ النَّبِيُّ ﷺ بِهِ الْمُهَاجِرَ وَيَأْذَنَ فِيهِ عُمَرُ ؓ لِلْيَهُودِ قَالَ الشَّيْخُ فَأَمَّا الْحَدِيثُ الَّذِي
الترجمة الإنجليزية
Al-Shafi'i said: 'We found that Umar (may Allah be pleased with him) expelled the Jews from the Arabian Peninsula and gave them a limit of three days. So we considered three days as what a traveler stays, and four days as more resembling a resident, because if the traveler could stay more than three, the Prophet (peace be upon him) would likely have allowed it for the emigrant, and Umar would have allowed it for the Jews.'
