أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ قَالَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ مَنْ مَرَّ لِرَجُلٍ بِزَرْعٍ أَوْ مَاشِيَةٍ أَوْ غَيْرِ ذَلِكَ مِنْ مَالِهِ لَمْ يَكُنْ لَهُ أَخْذُ شَيْءٍ مِنْهُ إِلَّا بِإِذْنِهِ؛ لِأَنَّ هَذَا مِمَّا لَمْ يَأْتِ فِيهِ كِتَابٌ وَلَا سُنَّةٌ ثَابِتَةٌ بِإِبَاحَتِهِ فَهُوَ مَمْنُوعٌ لِمَالِكِهِ إِلَّا بِإِذْنِهِ وَاللهُ أَعْلَمُ قَالَ وَقَدْ قِيلَ مَنْ مَرَّ بِحَائِطٍ فَلْيَأْكُلْ وَلَا يَتَّخِذْ خُبْنَةً وَرُوِيَ فِيهِ حَدِيثٌ لَوْ كَانَ يَثْبُتُ مِثْلُهُ عِنْدَنَا لَمْ نُخَالِفْهُ وَالْكِتَابُ وَالْحَدِيثُ الثَّابِتُ أَنَّهُ لَا يَجُوزُ أَكْلُ مَالِ أَحَدٍ إِلَّا بِإِذْنِهِ قَالَ الشَّيْخُ أَمَّا قَائِلُ هَذَا الْقَوْلِ فَعُمَرُ بْنُ الْخَطَّابِ ؓ
الترجمة الإنجليزية
Abu Sa'id ibn Abi Amr informed us: Abu al-Abbas al-Asamm narrated to us: al-Rabi reported to us; he said: al-Shafi'i, may Allah have mercy on him, said: Whoever passes by a man's crops, livestock, or other property of his has no [right] to take anything of it except with his permission; because this is a matter concerning which no [text of the] Book nor established Sunnah has come permitting it, so it is forbidden [to take] from its owner except with his permission. And Allah knows best. He said: It has been said: "Whoever passes by a walled garden (ha'it), let him eat but not take away a bundle (khubnah)." A hadith has been narrated concerning it which, had the like of it been established with us [as authentic], we would not have opposed; but the Book and the established hadith [indicate] that it is not permissible to eat anyone's property except with his permission. The Shaykh said: As for the one who said this statement, it is Umar ibn al-Khattab (may Allah be pleased with him).
