وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنا الرَّبِيعُ بْنُ سُلَيْمَانَ أنا الشَّافِعِيُّ أنا سُفْيَانُ بْنُ عُيَيْنَةَ عَنِ الْأَسْوَدِ بْنِ قَيْسٍ عَنِ ابْنِ الْأَقْمَرِ قَالَ أَغَارَتِ الْخَيْلُ بِالشَّامِ فَأَدْرَكَتِ الْخَيْلُ مِنْ يَوْمِهَا وَأَدْرَكَتِ الْكَوَادِنُ ضُحًى وَعَلَى الْخَيْلِ الْمُنْذِرُ بْنُ أَبِي حِمَّصَةَ الْهَمْدَانِيُّ فَفَضَّلَ الْخَيْلَ عَلَى الْكَوَادِنِ وَقَالَ لَا أَجْعَلُ مَا أَدْرَكَ كَمَا لَمْ يُدْرِكْ فَبَلَغَ ذَلِكَ عُمَرَ بْنَ الْخَطَّابِ ؓ فَقَالَ هَبِلَتِ الْوَادِعِيَّ أُمُّهُ؛ لَقَدْ أَذْكَرَتْ بِهِ أَمْضُوهَا عَلَى مَا قَالَ قَالَ الشَّافِعِيُّ وَلَوْ كُنَّا نُثْبِتُ مِثْلَ هَذَا مَا خَالَفْنَاهُ وَقَالَ فِي الْقَدِيمِ هَذَانِ خَبَرَانِ مُرْسَلَانِ لَيْسَ وَاحِدٌ مِنْهُمَا شَهِدَ مَا حَدَّثَ بِهِ

Ibn al-Aqmar said: The cavalry raided in Syria. The Arabian horses reached their destination that day, while the biradhins arrived the next morning. Al-Mundhir ibn Abi Himmah al-Hamdani was in charge of the cavalry. He gave preference to the Arabian horses over the biradhins and said: 'I will not treat what arrived the same as what did not arrive.' This reached Umar ibn al-Khattab (may Allah be pleased with him) and he said: 'May the Wadi'i's mother be bereaved of him! She has brought forth a capable man. Carry out what he said.' Al-Shafi'i said: If we could establish such a report, we would not have disagreed with it. And he said in the old opinion: These are two mursal reports; neither of them witnessed what he narrated.
