وَبِإِسْنَادِهِ عَنِ الشَّعْبِيِّ أَنَّ عَلِيًّا ؓ قَالَ فِي ابْنِ الْمُلَاعَنَةِ تَرَكَ أَخَاهُ وَأُمَّهُ لِأُمِّهِ الثُّلُثُ وَلِأَخِيهِ السُّدُسُ وَمَا بَقِيَ فَهُوَ رَدٌّ عَلَيْهِمَا بِحِسَابِ مَا وَرِثَا وَقَالَ عَبْدُ اللهِ لِلْأَخِ السُّدُسُ وَمَا بَقِيَ فَلِلْأُمِّ؛ فَهِيَ عَصَبَتُهُ وَقَالَ زَيْدٌ لِأُمِّهِ الثُّلُثُ وَلِأَخِيهِ السُّدُسُ وَمَا بَقِيَ فَفِي بَيْتِ الْمَالِ وَقَالَ عَبْدُ اللهِ لِلْأَخِ السُّدُسُ وَمَا بَقِيَ فَلِلْأُمِّ؛ فَهِيَ عَصَبَتُهُ وَقَالَ زَيْدٌ لِأُمِّهِ الثُّلُثُ وَلِأَخِيهِ السُّدُسُ وَمَا بَقِيَ فَفِي بَيْتِ الْمَالِ
الترجمة الإنجليزية
With the same chain from al-Sha'bi: Ali (may Allah be pleased with him) ruled regarding the child of li'an who left a brother and mother: the mother receives a third, the brother a sixth, and the remainder is returned to both proportionally. Abdullah said: the brother receives a sixth and the remainder goes to the mother, as she is his residuary heir. Zayd said: the mother receives a third, the brother a sixth, and the remainder goes to the public treasury.
