وَأَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ ثنا أَبُو بَكْرٍ مُحَمَّدُ بْنُ جَعْفَرٍ الْمُزَكِّي ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكُ بْنُ أَنَسٍ عَنْ يَحْيَى بْنِ سَعِيدٍ أَنَّهُ بَلَغَهُ أَنْ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ ؓ كَتَبَ إِلَى زَيْدِ بْنِ ثَابِتٍ يَسْأَلُهُ عَنِ الْجَدِّ فَكَتَبَ إِلَيْهِ زَيْدُ بْنُ ثَابِتٍ إِنَّكَ كَتَبْتَ إِلِيَّ تَسْأَلُنِي عَنِ الْجَدِّ وَاللهُ أَعْلَمُ وَذَلِكَ مَا لَمْ يَكُنْ يَقْضِي فِيهِ إِلَّا الْأُمَرَاءُ يَعْنِي الْخُلَفَاءَ وَقَدْ حَضَرْتُ الْخَلِيفَتَيْنِ قَبْلَكَ يُعْطِيَانِهِ النِّصْفَ مَعَ الْأَخِ الْوَاحِدِ وَالثُّلُثَ مَعَ الِاثْنَيْنِ فَإِنْ كَثُرَ الْإِخْوَةُ لَمْ يُنْقِصَاهُ مِنَ الثُّلُثِ 12434 قَالَ وَأنا مَالِكٌ أَنَّهُ بَلَغَهُ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ أَنَّهُ قَالَ فَرَضَ عُمَرُ بْنُ الْخَطَّابِ وَعُثْمَانُ بْنُ عَفَّانَ وَزَيْدُ بْنُ ثَابِتٍ ؓ لِلْجَدِّ الثُّلُثَ مَعَ الْإِخْوَةِ
الترجمة الإنجليزية
Abu Ahmad al-Mihrajani informed us: Abu Bakr Muhammad ibn Ja'far al-Muzakki narrated to us: Muhammad ibn Ibrahim narrated to us: Ibn Bukayr narrated to us: Malik ibn Anas narrated from Yahya ibn Sa'id that it reached him that Mu'awiyah ibn Abi Sufyan (may Allah be pleased with him) wrote to Zayd ibn Thabit asking him about the grandfather. Zayd ibn Thabit wrote to him: 'You have written to me asking about the grandfather. Allah knows best. This is a matter that only the rulers, meaning the caliphs, used to decide. I was present with the two caliphs before you who gave the grandfather half alongside one brother and a third alongside two. If the siblings were many, they did not reduce the grandfather below a third.' Malik also reported that Sulayman ibn Yasar said: 'Umar ibn al-Khattab, Uthman ibn Affan, and Zayd ibn Thabit (may Allah be pleased with them) assigned the grandfather a third alongside the siblings.'
