وَأَخْبَرَنَا أَبُو الْحَسَنِ الرَّفَّاءُ أنا عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ ثنا إِسْمَاعِيلُ الْقَاضِي ثنا ابْنُ أَبِي أُوَيْسٍ وَعِيسَى بْنُ مِينَاءٍ قَالَا ثنا ابْنُ أَبِي الزِّنَادِ عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ كُلُّ قَوْمٍ مُتَوَارِثِينَ مَاتُوا فِي هَدْمٍ أَوْ غَرَقٍ أَوْ حَرِيقٍ أَوْ غَيْرِهِ فَعُمِّيَ مَوْتُ بَعْضِهِمْ قَبْلَ بَعْضٍ فَإِنَّهُمْ لَا يَتَوَارَثُونَ وَلَا يُحْجَبُونَ وَعَلَى ذَلِكَ كَانَ قَوْلُ زَيْدِ بْنِ ثَابِتٍ وَقَضَى بِذَلِكَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ
الترجمة الإنجليزية
Abu al-Hasan al-Raffa' informed us: Uthman ibn Muhammad ibn Bishr narrated to us: Isma'il the judge narrated to us: Ibn Abi Uwais and Isa ibn Mina' narrated to us: Ibn Abi al-Zinad narrated from the jurists of Madinah who used to say: Any group of mutual heirs who die in a building collapse, drowning, fire, or other calamity, and it is unknown which died before the other, they do not inherit from each other and do not block each other's inheritance. This was the view of Zayd ibn Thabit, and Umar ibn Abd al-Aziz judged accordingly.
