أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ وَأَبُو بَكْرِ بْنُ الْحَسَنِ قَالَا ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنا الرَّبِيعُ أنا الشَّافِعِيُّ أنا مَالِكٌ وَسُفْيَانُ عَنْ أَبِي الزِّنَادِ عَنِ الْأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَبِيعُ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ مَالِكٍ وَقَدْ حَمَلَهُ الشَّافِعِيُّ رَحِمَهُ اللهُ عَلَى مَنِ اشْتَرَى مِنْ رَجُلٍ سِلْعَةً فَلَمْ يَتَفَرَّقَا حَتَّى أَتَاهُ آخَرُ فَعَرَضَ عَلَيْهِ مِثْلَ سِلْعَتِهِ أَوْ خَيْرًا مِنْهَا بِأَقَلَّ مِنَ الثَّمَنِ فَيَفْسَخُ بَيْعَ صَاحِبِهِ فَإِنَّ لَهُ الْخِيَارَ قَبْلَ التَّفَرُّقِ فَيَكُونُ هَذَا فَسَادًا وَقَدْ عَصَى اللهَ إِذَا كَانَ بِالْحَدِيثِ عَالِمًا وَالْبَيْعُ فِيهِ لَازِمٌ
الترجمة الإنجليزية
Abu Hurairah narrated that the Messenger of Allah (peace be upon him) said: "None of you should sell over the sale of another." Al-Shafi'i explained this to mean: when a man buys merchandise from another and before they part, a third person comes and offers similar or better merchandise at a lower price, causing the first buyer to cancel his purchase — this is forbidden. The buyer has the option to cancel before parting, and if someone interferes, he has sinned, but the sale remains binding.
