أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ أنا الرَّبِيعُ قَالَ قَالَ الشَّافِعِيُّ وَالنَّجْشُ أَنْ يَحْضُرَ الرَّجُلُ السِّلْعَةَ تُبَاعُ فَيُعْطِي بِهَا الشَّيْءَ وَهُوَ لَا يُرِيدُ شِرَاءَهَا؛ لِيَقْتَدِيَ بِهِ السُّوَّامُ فَيُعْطُونَ بِهَا أَكْثَرَ مِمَّا كَانُوا يُعْطُونَ لَوْ لَمْ يَسْمَعُوا سَوْمَهُ فَمَنْ نَجَشَ فَهُوَ عَاصٍ بِالنَّجْشِ إِنْ كَانَ عَالِمًا بِنَهْيِ رَسُولِ اللهِ ﷺ قَالَ وَالْبَيْعُ جَائِزٌ لَا يُفْسِدُهُ مَعْصِيَةُ رَجُلٍ نَجَشَ عَلَيْهِ قَالَ وَقَدْ بِيعَ فِيمَنْ يَزِيدُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَجَازَ الْبَيْعُ وَقَدْ يَجُوزُ أَنْ يَكُونَ زَادَ مَنْ لَا يُرِيدُ الشِّرَاءَ
الترجمة الإنجليزية
Al-Shafi'i said: "Najash is when a man attends the sale of merchandise and offers a price for it without intending to buy it, so that other bidders follow his lead and offer more than they would have offered had they not heard his bid. Whoever engages in najash is sinful if he knew of the Prophet's prohibition. The sale itself is valid; it is not invalidated by the sin of one who engaged in najash. Sales by auction were conducted during the time of the Messenger of Allah, and the sales were valid, even though someone who did not intend to buy may have bid."
