حَدَّثَنَا يَعْقُوبُ قَالَ حَدَّثَنَا ابْنُ أَخِي ابْنِ شِهَابٍ عَنْ عَمِّهِ قَالَ أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ أَنَّ عَائِشَةَ زَوْجَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَخْبَرَتْهُ أَنَّ بَرِيرَةَ دَخَلَتْ عَلَيْهَا تَسْتَعِينُهَا فِي كِتَابَتِهَا فَقَالَتْ لَهَا عَائِشَةُ وَنَفِسَتْ فِيهَا أَرَأَيْتِ إِنْ عَدَّيْتُ لِأَهْلِكِ الَّذِي عَلَيْكِ عَدَّةً وَاحِدَةً أَيَفْعَلُنَّ ذَلِكَ وَأُعْتِقُكِ فَتَكُونِي مَوْلَاتِي فَذَهَبَتْ بَرِيرَةُ إِلَى أَهْلِهَا فَعَرَضَتْ ذَلِكَ عَلَيْهِمْ فَقَالُوا لَا إِلَّا أَنْ يَكُونَ وَلَاؤُكَ لَنَا قَالَتْ عَائِشَةُ فَدَخَلَ عَلَيَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرْتُ لَهُ ذَلِكَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اشْتَرِي فَأَعْتِقِي فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ ثُمَّ قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَشِيَّةً فَقَالَ مَا بَالُ رِجَالٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ أَلَا مَنْ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللَّهِ فَلَيْسَ لَهُ وَإِنْ اشْتَرَطَ مِائَةَ مَرَّةٍ شَرْطُ اللَّهِ أَحَقُّ وَأَوْثَقُ.

Ya'qub narrated to us, he said: Ibn Akhi Ibn Shihab narrated to us, from his uncle, who said: Urwa ibn al-Zubayr informed me that Aisha, wife of the Prophet, peace and blessings be upon him, informed him that Barira entered upon her seeking her help with her contract of manumission. Aisha, being fond of her, said to her, "Would you like it if I paid your masters the full sum owed by you at once, and they agree, and I free you, so that you would become my freedwoman?" So Barira went to her masters and proposed that to them, and they said, "No, unless the right of patronage (wala) belongs to us." Aisha said: The Messenger of God, peace and blessings be upon him, entered upon me, and I mentioned that to him, and the Messenger of God, peace and blessings be upon him, said, "Buy her and free her, for the right of patronage belongs to the one who frees." Then the Messenger of God, peace and blessings be upon him, stood up that evening and said, "What is the matter with men who stipulate conditions that are not in the Book of God? Whoever stipulates a condition that is not in the Book of God, it is not valid for him, even if he stipulates it a hundred times. The condition of God is more binding and more valid."
