حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ هَارُونَ بْنِ رِئَابٍ عَنْ كِنَانَةَ بْنِ نُعَيْمٍ عَنْ قَبِيصَةَ بْنِ الْمُخَارِقِ الْهِلَالِيِّ تَحَمَّلْتُ بِحَمَالَةٍ فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَسْأَلُهُ فِيهَا فَقَالَ نُؤَدِّهَا عَنْكَ وَنُخْرِجُهَا مِنْ نَعَمْ الصَّدَقَةِ وَقَالَ مَرَّةً وَنُخْرِجُهَا إِذَا جَاءَتْنَا الصَّدَقَةُ أَوْ إِذَا جَاءَ نَعَمُ الصَّدَقَةِ وَقَالَ يَا قَبِيصَةُ إِنَّ الْمَسْأَلَةَ لَا تَصْلُحُ وَقَالَ مَرَّةً حُرِّمَتْ إِلَّا فِي ثَلَاثٍ رَجُلٍ تَحَمَّلَ بِحَمَالَةٍ حَلَّتْ لَهُ الْمَسْأَلَةُ حَتَّى يُؤَدِّيَهَا ثُمَّ يُمْسِكَ وَرَجُلٍ أَصَابَتْهُ حَاجَةٌ وَفَاقَةٌ حَتَّى يَشْهَدَ لَهُ ثَلَاثَةٌ مِنْ ذَوِي الْحِجَا مِنْ قَوْمِهِ وَقَالَ مَرَّةً رَجُلٍ أَصَابَتْهُ فَاقَةٌ أَوْ حَاجَةٌ حَتَّى يَشْهَدَ لَهُ أَوْ يَكَلَّمَ ثَلَاثَةٌ مِنْ ذَوِي الْحِجَا مِنْ قَوْمِهِ أَنَّهُ قَدْ أَصَابَتْهُ حَاجَةٌ أَوْ فَاقَةٌ إِلَّا قَدْ حَلَّتْ لَهُ الْمَسْأَلَةُ فَيَسْأَلُ حَتَّى يُصِيبَ قِوَامًا مِنْ عَيْشٍ أَوْ سِدَادًا مِنْ عَيْشٍ ثُمَّ يُمْسِكَ وَرَجُلٍ أَصَابَتْهُ جَائِحَةٌ اجْتَاحَتْ مَالَهُ حَلَّتْ لَهُ الْمَسْأَلَةُ فَيَسْأَلُ حَتَّى يُصِيبَ قِوَامًا مِنْ عَيْشٍ أَوْ سَدَادًا مِنْ عَيْشٍ ثُمَّ يُمْسِكَ وَمَا كَانَ سِوَى ذَلِكَ مِنْ الْمَسْأَلَةِ سُحْتٌ.
الترجمة الإنجليزية
Sufyan ibn Uyaynah narrated to us from Harun ibn Ri'ab, from Kinanah ibn Nu'aym, from Qabisah ibn al-Mukhariq al-Hilali: I incurred a debt for reconciling a dispute, so I came to the Messenger of God, peace and blessings be upon him, to ask him about it. He said: We will pay it off for you and provide it from the camels of the alms. And he said another time: and we will provide it when the alms comes to us, or when the camels of the alms come. And he said: O Qabisah, indeed begging is not proper - and he said another time: it is forbidden - except in three cases: a man who has incurred a debt to reconcile a dispute; for him begging is lawful until he pays it off, then he must stop. A man struck by need and poverty, until three people of sound judgment from his people testify to it - and he said another time: a man struck by poverty or need, until three people of sound judgment from his people testify or affirm that he has indeed been struck by need or poverty - for him begging becomes lawful, so he may beg until he attains a sufficiency of livelihood, then he must stop. And a man struck by a calamity that has destroyed his wealth; for him begging becomes lawful, so he may beg until he attains a sufficiency of livelihood, then he must stop. And whatever begging is beyond that is forbidden gain.
